1. Agreement to Terms

By accessing or using our AI-Powered POS System (the "Service"), you agree to be bound by these Terms of Use. If you disagree with any part of the terms, you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Our Service provides a cloud-based Point of Sale (POS) solution featuring AI-driven insights, inventory management, sales reporting, and customer relationship management. The Service is intended for business use only.

3. User Accounts

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account.

Security Warning: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. Subscription cycles are set either on a monthly or annual basis, depending on the plan you select.

Free Trial: We offer an 30-day free trial for new business accounts. After the trial, you must choose a paid plan to continue using the Service.
Refunds: Except when required by law, paid subscription fees are non-refundable.
Pricing Changes: We reserve the right to modify subscription fees at any time, with reasonable notice.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Dazzcode and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Limitation of Liability

In no event shall Dazzcode, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
